FAR Overhaul Tracker

The FAR is changing. Know what it means for your next bid.

The Revolutionary FAR Overhaul, also called FAR 2.0, is rewriting every part of the Federal Acquisition Regulation. See what has changed, where it already applies, and what to do next.

Verified Nov 2, 2026 against acquisition.gov, the Federal Register, and DoD's deviation list. Checked weekly.

These tracks run in parallel, not one after another. Until a final rule takes effect, the rewritten text reaches an agency through its own class deviation. (FAR overhaul FAQ)

Real changes from official sources, with what each one means for a contractor.

FAR Companion Version 3.0 published

What changed

The FAR Council's guidebook that accompanies the overhaul was updated. New material covers industry engagement, evaluation techniques, commercial buying, market research, and construction.

What it means for you (our reading)

The Companion is guidance, not regulation. It shows what contracting officers are being coached to do, and this version encourages more contact with industry before a solicitation. Answer the RFIs and go to the industry days in your lane.

Applies to: Guidance for every agency. It does not change any requirement by itself. Touches: Part 1, Part 7, Part 10, Part 12, Part 36

DoD updated its DFARS overhaul deviation list

What changed

DoD's list now shows 48 DFARS overhaul class deviations. 21 of them have been revised at least once.

What it means for you (our reading)

DoD solicitations use DoD's own deviation text, which can differ from the FAR Council's model text. Check the clause dates in each DoD solicitation.

Applies to: DoD solicitations only.

Last open comment window: GSA utility services

What changed

Comments on GSA's proposed rule for utility services (GSAR part 541) close November 4. All eight FAR overhaul comment periods have already closed.

What it means for you (our reading)

If you sell utility services to GSA, this is your last chance to comment. For everyone else, the next chance comes when the four remaining FAR proposed rules publish, and no date has been announced.

Applies to: GSA utility-services buys only. Touches: Part 41

  1. 1

    1. SAM reps and certs restructured; annual reps provision removed

What changed: Proposed rule keeps only entity-level representations and certifications in SAM and removes FAR 52.204-8 (Annual Representations and Certifications); procurement-specific reps move into each solicitation. Several SAM-related provisions are consolidated into 52.204-7 or a new Offeror Identification provision.

Do this now: Keep SAM current; expect to complete procurement-specific reps in individual solicitations once the rule is final; comment period closed July 23, 2026.

  2. 2

    2. Commercial buying rebuilt in Part 12; omnibus clauses 52.212-3 and 52.212-5 proposed for removal

What changed: Part 12 becomes a one-stop shop for commercial buys, embeds simplified procedures up to $9 million ($15 million for certain emergencies), and drops the omnibus reps/clauses; adding a clause not prescribed for commercial buys would require a deviation.

Do this now: Expect fewer clauses and combined synopsis/solicitations; read each solicitation clause list rather than relying on 52.212-5 checkboxes; track the final rule.

  3. 3

    3. Use existing contracts and required sources first (Part 8, best-in-class)

What changed: Part 8 reinforces using existing contracts and governmentwide vehicles before new awards; OFPP directed agencies to use best-in-class and preferred governmentwide contracts for common commercial buys. FSS ordering procedures move from the FAR to GSAR part 538 and FAR Parts 38 and 51 are proposed for removal.

Do this now: Assess whether you need a Schedule/GWAC/BPA position or a teaming path onto one; watch the GSAR part 538 rule.

    4. Small business set-asides: rule of two kept for contracts, order set-asides discretionary and not protestable

What changed: Model Part 19 text requires a set-aside above the micro-purchase threshold when two or more competitive small businesses are expected; set-asides of orders under multiple-award contracts are discretionary and the decision is "not a basis for protest".

Do this now: Engage contracting officers early on order set-asides; prepare comments for the Part 19 proposed rule (FAR Case 2026-004, no date announced).

    5. Part 15 source selection: negotiations, clarifications, competitive range, late proposals

What changed: Proposed rule replaces "discussions" with negotiations, narrows "deficiency" to non-conformance with a material RFP term, allows clarifications up to award, lets the competitive range hold proposals "best suited" for negotiation, lets COs accept late proposals in the Government interest, and recognizes highest-technically-rated-with-fair-price and phased evaluations.

Do this now: Expect more negotiation and possible down-selects; build proposals that can be negotiated on terms, IP and price; do not count on late-proposal rules as before.

    6. Fixed-price as the default contract type (E.O. 14402)

What changed: Contracts or orders that are other than fixed-price, or firm-fixed-price level-of-effort term, need an approved written justification at or above $100 million (DoD), $35 million (NASA), $25 million (DHS) or $10 million (other agencies); agencies were told to update Part 16/52 deviations by July 15, 2026.

    7. Multiple-award contracts: on-ramps/off-ramps, BPAs under MACs, order debrief explanations

What changed: Proposed Part 16 adds policies for adding and removing contractors on multiple-award contracts, allows BPAs under MACs, and requires on request a brief explanation for unsuccessful offerors on orders above the SAT up to $7.5 million.

Do this now: Watch for on-ramp windows; request order explanations when eligible; protect performance to avoid off-ramps.

    8. Termination settlements: 90 days instead of 1 year

What changed: Proposed rule shortens termination settlement proposal submission from 1 year to 90 days, inventory schedules from 120 to 60 days, and makes settlement audits risk-based instead of mandatory.

Do this now: Keep cost and inventory records ready to support a settlement proposal within 90 days.

    10. Data rights and SBIR/STTR rewritten in Part 27 using DFARS-derived rules

What changed: Proposed rule replaces FAR subpart 27.4 with DFARS-derived subparts for noncommercial and commercial technical data and software, and sets SBIR/STTR data protection at a single non-extendable 20-year period followed by Government purpose rights.

Do this now: Review data-rights markings and assertions practices against DFARS-style rules.

1

"Shall" replaced by "must" or "will"

Each published RFO proposed rule states revisions replace "shall" with "must" or "will" throughout the FAR text, provisions and clauses.

2

Non-statutory rules moved out of the FAR into non-mandatory guidance

Rules retain non-statutory requirements only when essential; beneficial but non-essential items move to the FAR Companion, Practitioner Albums and buying guides. FAR Companion Version 3.0 published October 30, 2026.

Source
3

Deregulation counted in requirements removed

OFPP: more than 500 requirements relieved and over 1,000 expected (Aug 15, 2025); more than 1,600 relieved in phase one and one-third fewer boilerplate requirements for commercial work (Sept 26, 2025).

4

Commercial-first buying

Part 12 consolidates commercial procedures, simplified procedures to $9 million, construction can qualify as a commercial service, and proposed FAR 7.201(f) requires buying commercial to the maximum extent practicable.

5

Fewer FAR parts and renumbering

Parts 10, 18 and 53 proposed reserved; Parts 38 and 51 proposed removed; Part 4 security content moves to Part 40; comment sought on renumbering all clauses into a new Part 52 subpart.

6

More contracting officer discretion, fewer mandated steps

Permissive contract-type framework, discretionary late-proposal acceptance and clarifications, market research methods left to agencies, order set-aside decisions not protestable.

7

Existing vehicles and category management over new contracts

Part 8 reinforces use of existing contracts; OFPP directed use of best-in-class and preferred governmentwide contracts; FSS ordering procedures move to the GSAR.

Deviation first, rulemaking second, with public feedback loops

Phase 1 model deviations, then 12 FAR cases for notice and comment; almost 1,600 comments received on model deviations (80% industry); "You Said, We Did" matrix tracks changes.

The overhaul also adds requirements

Rules fold in E.O. 14402 fixed-price justifications, an E.O. 14398 DEI clause as a debarment/suspension cause, and CUI 72-hour reporting; FAR Case 2026-001 is described as imposing "no more than de minimis costs" rather than as an E.O. 14192 deregulatory action, unlike the other seven.

Supplements follow the FAR: GSAR and DFARS overhauls

GSA issued RGO-2026-01 deviations and two GSAR proposed rules; DoD lists 48 DFARS RFO class deviations and imports DFARS-style data rights into FAR Part 27.

FAR overhaul questions, answered

What is the Revolutionary FAR Overhaul?+

It is the federal government's rewrite of the Federal Acquisition Regulation, started by Executive Order 14275 in April 2025. The FAR Council first published model text for every FAR part, which agencies adopt through class deviations. It is now moving the changes through formal notice-and-comment rulemaking. People also call it FAR 2.0 or the RFO.

Is the new FAR text already in effect?+

It depends on the agency. Model text applies at an agency only after that agency issues a class deviation adopting it. DoD's deviations took effect starting February 1, 2026. No final rule has been published yet, so the official FAR itself has not changed.

Does the overhaul change my existing contracts?+

Not by itself. A contract keeps the clauses it was awarded with unless it is modified. The changes reach new solicitations first. Read the clause list and dates in each new solicitation.

Can I still comment on the proposed rules?+

All eight FAR overhaul proposed rules published so far have closed for comment, on July 23 and October 19, 2026. Four more FAR cases are planned, including Part 19 (Small Business), and no publication date has been announced. This tracker lists each new comment window as it opens.

What happened to FAR Part 19 small business rules?+

The model text keeps the rule of two for contracts: a set-aside is required above the micro-purchase threshold when two or more competitive small businesses are expected. Set-asides of orders under multiple-award contracts become discretionary, and that decision is not a basis for protest. The Part 19 proposed rule (FAR Case 2026-004) has not been published.

Where does this tracker get its information, and how often is it updated?+

Only from public government sources: acquisition.gov, the Federal Register, and agency deviation pages, including DoD's DFARS list. Every item links to its source. The tracker is checked every week, and the date at the top shows the last check. Plain-English explanations are Honest Echo's reading, not regulatory text.

How this tracker works

Every week we check the official sources below, update the counts, and log what changed. Every fact links to the government page it came from. Where the government hasn't announced a date, the tracker says "No date announced" rather than guessing. Text marked "our reading" and the impact rankings are Honest Echo's interpretation, not regulatory text or legal advice.
